Contesting a Citation

If an individual believes they were wrongfully cited, they have the right to contest the citation. The individual may contest the citation by filling out a waiver form. Contesting a citation must take place within twenty-one (21) calendar days of the issuance of the citation.

Waiver forms are available at the Parking Control Office (Room 902) or by clicking here.

Please keep in mind that forgetting to properly display a valid parking permit; not knowing the regulations and/or not seeing the posted signs are not acceptable grounds for having a citation waived.

WAIVER PROCESS

Once the waiver form is submitted to the Parking Control Office, the waiver is forwarded to the Imperial Valley College hearing examiner.  After the hearing examiner reviews the case and makes a decision, the individual contesting the citation will be contacted with the results either via e-mail, letter, or by telephone (based up on what contact information is provided on the waiver form) within seven (7) to nine (9) business days after the waiver form was submitted. If waiver results are not received within ten (10) business days, it is the responsibility of the individual contesting the citation to contact the Parking Control Office for the results.  If the waiver is granted, no further action is required.

If the individual is dissatisfied with the Hearing Examiner's decision, they may continue to contest the citation by requesting an administrative hearing through the appeal process.

APPEAL PROCESS

1.  You must first submit a request for a waiver of your parking citation (see Waiver Process above) within 21 days of the date the citation was issued.  If your waiver request is denied, you may then request an administrative hearing.

2.  Hearing Examiner Appointment:

  • An appeal form must be submitted to the Imperial Valley College Parking Control Office.  
  • The appeal form must be filled out in its entirety and returned to the Parking Control Office with a deposit for the total amount of the citation.

You will be contacted with the date and time of your hearing with the independent hearing examiner.

If your appeal is accepted, the deposit will be returned to you. If your appeal is denied, the deposit will be used as payment for your citation.
