CONTESTING A CITATION 

If an individual believes they were wrongfully cited, they have the right to contest the citation.  The individual may contest the citation by filling out a waiver form.  Contesting of the citation must take place within twenty-one (21) calendar days of the issuance of the citation.

Waiver forms are available at the Parking Control Office (building 500, office 517) on main campus or by clicking here.

Please keep in mind that forgetting to property display a valid parking permit; not knowing the regulations and/or not seeing the posted signs are not acceptable grounds for having a citation waived.    

WAIVER PROCESS

Once the waiver form is sbumitted, the waiver is forwarded to the Imperial Valley College Hearing Examiner.

After the hearing examiner examines the case and makes a decision, the individual contesting the citation is contacted with the results either via e-mail, a letter,l or by telephone (based up on what contact information is provided on the waiver form) within seven (7) to nine (9) business days after the waiver form was submitted.  If waiver results are not recieved within ten (10) business days, it is the responsibility of the individual contesting the citation to contact the Parking Control Office for the results.

If the waiver is granted, no further action is required.

If the individual is dissatisfied with the Hearing Examiner's decision, they may continure to contest the citation by requesting an administrative hearing and submit an appeal form.

APPEAL FORM PROCESS 

In order for an appeal request to be processed, the forllowing instructions must be followed:

I. Initial Waiver:  You must submit a waiver form, which is the first process, before the citation is twenty-one (21) calendar days old.  If your waiver is denied you may choose to have an administrative hearing. 

  • Forgetting to display permit, not knowing the regulations and/or not seeing the posted signs are not acceptable grounds for review.
  • Any decision made by the Parking Citation Review Examiner will be emailed to you within 3 to 5 weeks to the address indicated on the submitted appeal form.  You are responsible for contacting the Parking Control Office if you do not recieve a response within 14 business days.

II. Hearing Examiner Appointment: If you waiver has been denied, you may choose to have your case heard by an independent hearing examiner by following the directions below:

An appeal form may be obtained at the Imeperial Valley College Parking Control Office via email or through mail with the results of your waiver form.

The appeal form must be filled out in its entirety and returned to the Parking Control Office with a deposit for the total amount of the citation.

You will be contacted with the date and time of your hearing with the independent hearing examiner.

If your appeal is accepted, the deposit will be returned to you.  If your appeal is denied, the deposit will be used toward your citation payment.
